Bloom Services and Trading provides professional business and digital services, including but not limited to:

2 Website maintenance and hosting

3. Digital marketing services

4. Branding and graphic design

5. Business consulting and advisory services

6. Content creation and related business support services

The specific scope of services shall be outlined in a separate proposal, quotation, agreement, or invoice issued to the client.

3. CLIENT RESPONSIBILITIES

Clients agree to:

Provide accurate and complete information necessary for project completion.

Supply content, images, logos, credentials, and other required materials in a timely manner.

Review and approve submitted work within agreed timelines.

Ensure that any content supplied does not infringe upon the rights of third parties.

Maintain backups of their own business records and data where applicable.

Delays caused by the client may result in project timeline extensions.

4. PAYMENT TERMS

4.1 Fees

All fees are quoted in Omani Rial (OMR) unless otherwise stated.

4.2 Deposits

Projects may require an upfront deposit before work commences. The deposit amount shall be specified in the relevant proposal or quotation.

4.3 Invoices

Invoices are payable within the period specified on the invoice.

4.4 Late Payments

Bloom Services and Trading reserves the right to:

Suspend ongoing work;

Withhold project deliverables;

Suspend website hosting or maintenance services;

Terminate services for accounts with outstanding balances.

4.5 Taxes

Clients are responsible for any applicable taxes, duties, or governmental charges unless otherwise stated.

5. REFUND POLICY

Due to the nature of digital and professional services:

Deposits and advance payments are generally non-refundable once work has commenced.

Payments for completed work are non-refundable.

Refund requests will be reviewed on a case-by-case basis at the sole discretion of Bloom Services and Trading.

No refunds shall be provided for services already delivered, completed milestones, consultation sessions, or hosting fees already incurred.

6. INTELLECTUAL PROPERTY

6.1 Client Materials

The client retains ownership of all content, trademarks, logos, and materials provided to Bloom Services and Trading.

6.2 Company Materials

Bloom Services and Trading retains ownership of:

Proprietary methodologies;

Templates;

Frameworks;

Processes;

Design elements not specifically created for the client;

Internal systems and tools.

6.3 Project Deliverables

Upon full payment of all outstanding invoices, ownership of the final approved deliverables shall transfer to the client, unless otherwise agreed in writing.

Bloom Services and Trading reserves the right to display completed work in its portfolio, marketing materials, and promotional content unless otherwise agreed in writing.

7. WEBSITE HOSTING TERMS

Where website hosting services are provided:

7.1 Hosting Services

Hosting services are provided on a subscription basis and are subject to recurring fees.

7.2 Service Availability

While we strive to maintain maximum uptime, uninterrupted availability cannot be guaranteed.

7.3 Third-Party Providers

Hosting services may utilize third-party infrastructure providers. Bloom Services and Trading shall not be liable for outages, interruptions, security incidents, or failures caused by third-party providers.

7.4 Suspension

Hosting services may be suspended for:

Non-payment;

Illegal activities;

Security concerns;

Excessive resource usage;

Violations of these Terms.

7.5 Backups

While reasonable efforts may be made to maintain backups, clients remain responsible for maintaining independent backups of their website content and business data.

8. CONFIDENTIALITY

Both parties agree to maintain the confidentiality of any non-public business, technical, financial, or operational information disclosed during the course of a project.

Confidential information shall not be disclosed to third parties except:

With prior written consent;

As required by law;

To professional advisors bound by confidentiality obligations.

This obligation shall survive the completion or termination of services.

9. THIRD-PARTY SERVICES

Projects may involve third-party platforms, software, domains, hosting providers, payment processors, plugins, or applications.

Bloom Services and Trading is not responsible for:

Third-party service outages;

Changes in pricing;

Policy changes;

Security breaches;

Service discontinuations;

Performance issues caused by third-party providers.

Any fees charged by third-party providers remain the responsibility of the client.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Bloom Services and Trading shall not be liable for:

Indirect damages;

Consequential damages;

Loss of profits;

Loss of revenue;

Loss of business opportunities;

Data loss;

Business interruption.

Our total liability arising from any claim relating to our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.

11. WARRANTIES DISCLAIMER

Services are provided on an "as-is" and "as-available" basis.

Bloom Services and Trading does not guarantee:

Specific business results;

Search engine rankings;

Revenue increases;

Lead generation outcomes;

Continuous website uptime;

Compatibility with all future technologies or platforms.

12. TERMINATION

Either party may terminate a project or service arrangement upon written notice.

Upon termination:

Outstanding fees become immediately due.

Work completed up to the termination date shall be billable.

Hosting and maintenance services may be discontinued.

Access credentials and deliverables will be released upon settlement of outstanding balances.

13. INDEMNIFICATION

The client agrees to indemnify and hold harmless Bloom Services and Trading from claims, damages, liabilities, costs, and expenses arising from:

Client-supplied content;

Intellectual property infringements;

Misuse of services;

Violations of applicable laws or regulations.

14. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Sultanate of Oman.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Sultanate of Oman.

15. CHANGES TO THESE TERMS

Bloom Services and Trading reserves the right to modify these Terms and Conditions at any time.

Updated versions will be published on our website and become effective upon publication.
